2 General Provisions
2.a These General Terms and Conditions govern the use of the accommodations and services of the Service Provider.
2.b Specific conditions are not part of these General Terms and Conditions.
2.c The General Terms and Conditions do not exclude the conclusion of individual agreements with travel agents or organizers, which may vary according to the type of business.

3 Contracting Parties
3.a The guest uses the services offered by the Service Provider.
3.b If the guest orders the services directly from the Service Provider, the guest becomes a contracting party. The Service Provider and the guest will, when the conditions are met, become contracting parties (hereinafter referred to as “parties”).
3.c If the services are ordered on behalf of the guest by a third party (hereinafter referred to as the “intermediary”), the contract between the Service Provider and the intermediary governs the terms of cooperation. In this case, the Service Provider is not obliged to check whether the third party is lawfully representing the guest.

4 Conclusion of the Contract, Booking Method, Modification, Notification Obligation
4.a Upon the verbal or written request of the guest, the Service Provider sends an offer. If no concrete booking is made within 48 hours after sending the offer, the Service Provider’s obligation to the offer expires.
4.b The contract is concluded when the guest’s booking is confirmed in writing by the Service Provider. Oral bookings, agreements, or their oral confirmation by the Service Provider are not considered a contract.
4.c The contract for the use of the service is valid for a specific period. If the guest leaves the hotel permanently before the agreed period expires, the Service Provider is entitled to the full payment for the agreed services. The Service Provider has the right to resell the room before the period expires. An extension of the use of the services by the guest requires the prior consent of the Service Provider. In this case, the Service Provider may demand the payment for the services already provided.
4.d Amendments and/or additions to the contract require the written agreement of the parties.

5 Cancellation Conditions
5.a Unless the Service Provider specifies other conditions in the offer, the service can be cancelled free of charge until 16:00 two days before arrival (local time).
5.b If the contracting party fails to secure the services by prepayment, credit card guarantee, or other contractually specified methods, the Service Provider’s obligation to provide the services expires at 16:00 one days before arrival (local time).
5.c If the contracting party secures the services by prepayment, credit card guarantee, or other contractually specified methods but does not appear by 24:00 (local time) on the day of arrival and/or does not announce the non-appearance in writing, the Service Provider will claim the entire contractually agreed amount as a penalty. In this case, the Service Provider will reserve the room for the contracting party until 12:00 the following day, after which the Service Provider’s obligation to provide the services expires.
5.d The Service Provider reserves the right to withdraw from providing the ordered and confirmed services in writing no later than 30 days before use, with any advance payments being refunded simultaneously.
5.e When using services under special conditions (promotions, group travel, or events), different conditions may be set out in an individual contract.

6 Prices
6.a The room prices of the apartments operated by the Service Provider are available on the apartment’s website (www.gerihomes.hu).
6.b The Service Provider may freely change the published prices without prior notice.
6.c When announcing prices, the Service Provider specifies the tax rate (VAT, tourist tax) applicable at the time of the offer. Changes in the tax burden due to legislative changes will be passed on to the contracting party after prior notice.
6.d Current discounts, promotions, and other offers are published on our website (www.gerihomes.hu).

7 Payment Method, Guarantee
7.a The Service Provider requires payment for the services no later than before arrival and before check-in to the apartments.
7.b The Service Provider may request a credit card guarantee (50% of the total amount), with the value of the ordered and confirmed services being blocked on the credit card.
7.c The Service Provider may request the prepayment of part or the entire amount.
7.d The contracting party may pay for the services in HUF and/or in another currency accepted by the Service Provider. The conversion and invoicing are based on the exchange rate of the Service Provider’s bank valid on the day of the guest’s arrival.
7.e The Service Provider accepts cashless payment methods (credit card, Széchenyi Recreation Card, gift vouchers, vouchers, etc.), the current list of which is available to the contracting party upon request. It is recommended to specify the selected payment method already at the time of booking.

8 Use of Service and Conditions
8.a The guest can occupy the room or apartment from 15:00 on the day of arrival (check-in) and must leave it by 11:00 on the day of departure (check-out).
8.b In principle, the apartment may only be used by the number of persons specified in the contract.
8.d Accommodation for children under 3 years is free of charge when staying in the same apartment with parents. For arrivals with more than one child under 4 years, an extra bed will be charged.
8.e Fees payable for children aged 4 and over are included in the current price list.

9 Pets
9.a When arriving with pets, the guest is required to know, acknowledge, and comply with the accommodation’s current rules no later than upon arrival. The guest can find out about the current rules on the hotel’s websites and contact the apartments at the provided contacts before arrival.
9.b The guest is fully responsible for any damage caused by the pet.

10 Refusal of Contract Performance, Expiry of Service Obligation
10.a The Service Provider is entitled to terminate the contract with immediate effect and refuse the services if:
10.a.1 the guest does not comply with the house rules;
10.a.2 the guest does not use the provided room or facility as intended;
10.a.3 the guest behaves inappropriately or rudely, is under the influence of alcohol or drugs, exhibits threatening, offensive, or other unacceptable behavior;
10.a.4 the guest suffers from an infectious disease;
10.a.5 the contracting party does not fulfill its payment obligation within the specified period set out in the contract.
10.b In the event of force majeure, the contract terminates, and the parties settle the services rendered.

11 Accommodation Guarantee
11.a If the Service Provider cannot provide the services specified in the contract due to its own fault (e.g., overbooking, temporary operational issues), it is obliged to arrange the guest’s accommodation immediately.
11.b The Service Provider is obliged:
11.b.1 to offer the services specified in the contract at the confirmed price and for the agreed duration – or until the obstacle is resolved – in another accommodation of the same or higher category. All additional costs for the substitute accommodation are borne by the Service Provider.
11.b.2 to provide a free transfer to the offered accommodation at the guest’s request.
11.c If the Service Provider fulfills its above obligations in full and the guest accepts the offered substitute accommodation, the contracting party cannot make any subsequent claims for compensation.

12 Illness or Death of the Guest
12.a If the guest becomes ill during the use of the service and is unable to care for themselves, the service provider offers medical assistance.
12.b In the event of the illness or death of the guest, the service provider is entitled to reimbursement of the costs incurred from the patient or their heirs, including any medical and procedural costs, the room price in connection with the illness or death, and compensation for any services and damages incurred.

13 Rights of the Contracting Party (Guest)

13.a The guest has the right to use the ordered accommodation and services in accordance with the contract. 13.b The guest can report any complaint regarding the provision of services by the service provider on the spot during their stay in the accommodation. During the provision of services, the service provider is obliged to rectify any deficiency or error caused by them. 13.c Any complaints from the guest during the use of the accommodation services are accepted in writing (or recorded) by the service provider.

14 Obligations of the Contracting Party (Guest)

14.a The guest is obliged to pay the agreed value of the services at a specified time and in a specified manner. 14.b The guest is obliged to ensure that children under 18 years of age accompanying them are only in the accommodation under the supervision of an adult. 14.c The guest is not allowed to consume their own food and drinks in the public areas of the apartments. 14.d The guest is not allowed to take devices and furnishings from the apartment.

15 Guest’s Liability for Damages

15.: The guest is responsible for all damages and disadvantages caused to the service provider or a third party by their own behavior, the behavior of those accompanying them, or by other persons for whom they are responsible, or by pets. This liability also exists if the injured party has the right to claim compensation directly from the service provider.

16. Rights of the Service Provider

If the Guest fails to fulfill their payment obligations for the services used or ordered under the contract but not utilized and subject to a penalty, the Service Provider has a lien on the Guest’s personal belongings that they have brought into the hotel to secure its claim.

17. Obligations of the Service Provider

17.a To fulfill the accommodation and other services ordered under the contract in accordance with the applicable regulations and service standards.

17.b To investigate the Guest’s written complaint and take the necessary steps to address the issue, which must also be recorded in writing.

18. Liability of the Service Provider

18.a.1 The Service Provider is liable for any damage suffered by the Guest that occurs within its facilities due to the fault of the Service Provider or its employees.

18.a.2 The Service Provider’s liability does not extend to damages caused by unavoidable events beyond the control of the Service Provider, its employees, or guests, or those caused by the Guest.

18.a.3 The Guest must report any damage suffered immediately at the hotel and provide all necessary information to clarify the circumstances of the incident, including, if necessary, for a police report or legal proceedings.

18.b The Service Provider is also liable for damages resulting from the loss, destruction, or damage of the Guest’s belongings if they were placed in a designated or generally intended location for safekeeping, in the room’s safe, or handed over to an employee of the Service Provider who could be considered authorized to receive them. The Service Provider is only responsible for valuables, securities, and cash if they have been explicitly accepted for safekeeping or if the damage occurred due to a cause for which the Service Provider is liable under general rules. In such cases, the burden of proof lies with the Guest.

19. Data Security

The Service Provider considers the protection of personal data a priority. Any personal data provided will be processed in compliance with the applicable laws. The Service Provider ensures their security, takes the necessary technical and organizational measures, and establishes the procedural rules required for compliance with relevant regulations.

The Service Provider processes user data exclusively for contract execution, invoicing, and its own marketing purposes, in accordance with data protection laws.

By entering into the accommodation contract, you acknowledge that you have read, understood, and agreed to the above terms and conditions. The General Terms and Conditions may be subject to future modifications.

19.1 The Service Provider protects data against unauthorized access, modification,

transmission, disclosure, deletion, or destruction, as well as accidental destruction or damage.

19.2 The Service Provider, in collaboration with the server operators, ensures data security.

19.3 Only the data controller’s employees have access to the personal data provided by the User. Personal data is not disclosed to third parties beyond the specified recipients.

19.4 The Service Provider does not share personal data with third parties unless the concerned individual has given prior explicit consent.

19.5 The User acknowledges that the Service Provider is legally obligated to provide personal data to requesting authorities if the legal conditions are met. The User may not object to data disclosure based on laws, official authority, or court orders.

20. Force Majeure

Any event or circumstance (e.g., war, fire, flood, adverse weather conditions, power outage, strike, epidemic) that is beyond the control of either party. Either party is released from fulfilling contractual obligations as long as such an event or circumstance persists. The parties agree to take all reasonable measures to minimize the risk of such occurrences and mitigate any resulting damage or delay as soon as possible.

21. Confidentiality

In fulfilling its contractual obligations, the Service Provider is required to comply with laws governing the protection of personal data and the disclosure of public information. The detailed rules on the processing of personal data are outlined in the Service Provider’s Privacy Policy
